  • Types of Copyright                                                                                                              

                    ◎  Written works;

                    ◎  Oral works;

                    ◎  Musical, dramatic, quoi,choreographicandacrobatic works;

                    ◎  Paintingand architecturalworks;

                    ◎  Photographic works;

                    ◎  Cinematographicworks and works created by virtue of the analogous  method of  film production;

                    ◎  Graphic works such as diagrams of project design, drawings of product design, maps and
                          sketches as well as works of their model;

                    ◎  Computer software;

                    ◎  Other works as provided for in law and administrative rules andregulations.

  •  The Subsistence of Copyrights                                                                                          

                     ◎  Copyrightof Chinese Citizens

                           When a work is created,Chinese citizens, legal persons, or entities without legal personality
                           shall enjoy copyright, no matter such work is published or not.

                     ◎  Copyright Protectionof a Foreigner or Person Without Nationality

                           1.The work of a foreigner or a stateless personwhich is first published in the territory of
                                   China shall be protected on the date when the work is first published.

                           2.The work of a foreigner or a stateless personwhich is published in the territory of 
                                   China within 30 days after first published outside China shall be deemed published in
                                   China at same time.

                           3.Copyright enjoyed by works of foreigners and stateless persons according to the
                                   agreements signed by China and the States of which the authors are nationals or in
                                   which the authors domicile habitually or the international conventions to which both
                                   China and the States are members shall be protected by ChineseLaw.

                           4.Works of authors of the States which have not signed the agreements with China or
                                   have not joined the international conventions to which China is the member and works
                                   of stateless persons shall be protected by Chinese Law, if they are first published in the
                                   Member States of the international conventions to which China is the member or are 
                                   simultaneously published in the Member and Non-member States.

  • Content of Copyright                                                                                                           

    Copyright shall include the following personal rights and property rights:

                    ◎  Right of Adaptation                 

                    ◎  Right of Translation

                    ◎  Right of Information Network Dissemination

                    ◎  Other Rights that Shall be Enjoyed by Copyright Owners.

  • Remedies for Iinfringement of the Copyrights                                                                   

                    ◎  Civil Procedures

                          1.Any of the acts of infringement for copyright shall, depending on its circumstances, be
                                  demanded for civil responsibility such as cease of the infringement, elimination of effects,
                                  public apology and compensation for loss.

                          2.If a copyright or copyright-related right is infringed, compensation shall be paid according
                                  to the actual loss of the right owner by the person who made the infringement; if the
                                  computation of the actual loss is difficult, compensation may be paid according to the illegal
                                  gains of the person who made the infringement. The compensation shall also include the
                                  reasonable expenses of the right owner for preventing the act of infringement.

                          3.If the actual loss of the right owner or the illegal gains of the person who made the
                                  infringement could not be ascertained, the people's court shall judge the compensation not
                                  exceeding 500,000 Yuan depending on the circumstances of the act of infringement.

                          4.A copyright owner or copyright-related right owner who has evidence to establish that
                                  another person is committing or will commit an act of infringing his right, which could
                                  cause a remediless loss to his legitimate rights and interests if the act is not prevented
                                  immediately, may apply to a people's court for adopting such measures as order to stop
                                  the relevant act and property preservation before he initiates an action.

                          5.For the purpose of preventing the act of infringement and under the circumstances where
                                  the evidence could be lost or is difficult to obtain afterwards, the copyright owner or
                                  copyright-related right owner may apply to a people's court for evidence preservation 
                                  before he initiates an action.

                          6.If the applicant fails to initiate the action within 15 days after the people's court has 
                                  adopted the measures of preservation, the latter shall terminate the measures of preservation.

                          7.A copyright dispute may be mediated and also, may be filed with an arbitration organization
                                  for arbitration according to the arbitration agreement concluded by the parties concerned
                                  or the arbitration clause in the copyright contract.

                          8.The party concerned who fails both to reach an arbitration agreement and to stipulate the
                                  arbitration clause in the copyright contract may initiate an action directly before a people's
                                  court.


                     ◎  CriminalProcedures

                         1.Article 217 of Criminal Law of the People's Republic of China: A person who, with a
                                 view of profit, commits any of the following acts of infringing upon copyright, shall be
                                 sentenced to fixed-term imprisonment of not more than three years or criminal detention
                                 and concurrently or independently, to a fine if the amount of illegal gains is relatively huge
                                 or any other serious circumstance exists; and if the amount of illegal gains is huge or any
                                 other especially serious circumstance exists, to fixed-term imprisonment of not less than
                                 three years and not more than seven years and concurrently to a fine:

                                1-1.To reproduce and distribute, without the permission of a copyright owner, a
                                                written work or musical, cinematic, television or video work, or computer
                                                software or any other work of the latter;

                                1-2.To publish a book of which another person has the exclusive publishing right;

                                1-3.To reproduce and distribute, without the permission of a phonogram or video
                                                gram producer, a phonogram or video gram produced of the latter; or

                                1-4.To produce and sell a work of art bearing the forged signature of another person.

                         2.Article 218 of Criminal Law of the People's Republic of China: A person who, with a
                                 view of profit, sells those which he well knows infringing reproductions specified in Article
                                 217 of Criminal Law, shall be sentenced to fixed-term imprisonment of not more than three
                                 years or criminal detention and concurrently or independently, to a fine, if the amount of his
                                 illegal gains is huge.
